Frequently Asked Questions About Traffic Cases

Why should I not just prepay or agree to trial in my absence?

        Obviously you have the right to do so, but the repercussions may be greater than you might expect.  In addition to obvious financial and other immediate concerns, a conviction of reckless driving will result in a permanent criminal conviction on your record.  Your driving record and your criminal record are not the same thing.  Call for a free consultation before proceeding.

What is the difference between speeding and reckless driving?

        In Virginia, speeding is a traffic offense punishable by fine and the payment of Court Costs. Speeding 1-9 miles per hour over the posted limit is a 3 point offense. Speeding 10-19 miles per hour over the posted limit is a 4 point offense. Speeding 20 or more miles per hour over the limit (when not charged as reckless driving) is 6 point offense. 

        Reckless Driving, whether generally or by speed is a criminal offense in Virginia. It is a Class 1 Misdemeanor, and the same level offense as driving under the influence of alcohol or drugs. The Court has discretion to sentence an individual found guilty of Reckless Driving to up to 12 months in jail and a fine of $2,500.00. While incarceration is usually limited to extreme cases, high fines and license suspensions can also be imposed. It is a 6 point offense. Every case is different.         Improper Driving is a 3 point traffic offence, and considered a lesser included offense to Reckless Driving.

I am not a Virginia resident. Will point infractions be reported to my state?

        In most cases, yes.

Other than speeding and reckless driving, are there other point offenses in Virginia?

Will being convicted of a moving violation change my insurance rates?

        This would depend on your insurance company, your driving record and other factors. Discuss this with your insurance agent.

What can The Fisher Law Firm do for me?

The process involves evaluating the specific facts of your case, and speaking with the officer involved or the Attorney for the Commonwealth. Will I still have to come to Court?

        In most cases we will be able to appear on your behalf. If you still need to appear, you will be told so by the attorney during your consultation.

What will be the cost to me?

        This will depend on the facts of your case and the nature and number of your charges. In addition to fees for our services, there may be Court costs and fines as well. The fees for our services are competitive, and in some cases special payment arrangements can be made. We will discuss this with you during your free consultation.
